Donald Trump’s former adviser, Steve Bannon, was convicted of contempt in 2022. This happened after he was unable to provide evidence of the US Capitol attack that occurred on January 6, 2021. At that time, he was sentenced to four months imprisonment. This is exactly the same sentence former Trump adviser Peter Navarro is serving.
Navarro is serving jail time for refusing to provide evidence of the US Capitol attack. Luckily for Bannon, he didn’t serve jail time after being sentenced to four months imprisonment. This is because Judge Carl Nichols had paused the sentence. However, it seems the judge has decided to proceed with Bannon’s sentence.
Steve Bannon and His Lawyers Speak on His Sentence
In May, the appeal court upheld Bannon’s case. At that time, a motion was filed to Judge Nichols to order Bannon to report to prison. All this happened after the appeal court rejected Bannon’s appeal. According to Federal prosecutors, since Bannon’s appeal was denied, there’s no legal basis for why he shouldn’t be in prison.

Bannon’s lawyers don’t support the Federal prosecutor’s judgment. They requested that the sentence be kept until they can appeal to the full appeals court and the Supreme Court. If Judge Nichols pays attention to the lawyers, the delay would be in Bannon’s favor.
This is because if Trump wins the election, he’ll pardon Bannon just as he did in 2021. On the other hand, the judge Trump appointed says he has the authority to lift Bannon’s sentence as they continue seeking an appeal of the conviction.
Aside from Bannon’s lawyers fighting for him, he has vowed to fight his contempt of Congress conviction until it gets to the Supreme Court. He further said that absolutely nothing can shut him up—no prison or jail built can. Also, Bannon seems certain he’d win the case if it’s taken to the Supreme Court.
Furthermore, Bannon claimed that the prosecution he received was all about “shutting down the MAGA movement, shutting down grassroots conservatives, shutting down President Trump.” He said it had absolutely nothing to do with involvement in hiding evidence of the attack that happened at the Capitol.
More on Bannon’s Case
Trump posted on his social website that Bannon’s sentence was a “Total and Complete American Tragedy.” He also suggested that members of the January 6 committee should be prosecuted. Bannon’s lawyer, David Scheon, tried to talk the Federal judge into allowing him to stay out of prison. But the conversation didn’t end well. It turned into a heated argument.

Aside from the January 6 case, Bannon has another trial he’d have to attend in New York later this year. Some allegations were made against him, such as defrauding people who gave him money to build a wall on the border of the Southern US. In this case, Bannon pleaded innocent.
This isn’t the first time Bannon has been charged with such schemes. He was first charged with a similar scheme in 2021, two weeks before the Capitol attack. However, at that time, Trump pardoned him. While Bannon was going into the courthouse on the morning of June 6, an individual around the court said, “Trump, 24!” he smiled as he heard those words.
Who Is the Judge on Bannon’s Case
Judge Carl Nichols was appointed by Trump to the bench in 2018. The judge has handled several of the January 6 cases that Bannon and Navarro were convicted of. Nichols is the judge who has refused individuals from obstructing their proceedings. The obstruction rule has been used by hundreds of individuals who were defendants in the January 6 case.
On June 5, one of the defendants in the January 6 case was sentenced to more than six years imprisonment for assaulting law enforcement officers. Federal Judge Nichols passed this sentence. The individual was caught thanks to a sting operation launched by a lady on the Bumble app.
